Terms and conditions of purchase

GRAPHENANO COMPOSITES, S.L. (hereinafter, THE COMPANY) welcomes you and invites you to carefully read the General Terms and Conditions of Sale applicable to its products. These are governed by the present general conditions, unless THE COMPANY expressly agrees in writing to modify any of these conditions. Since GRAPHENANO COMPOSITES, S.L. may modify these Terms of Sale in the future, we recommend that you visit them periodically to stay informed of any changes.

Through the Website, THE COMPANY provides information about its products and offers the possibility of purchasing them. Due to the content and purpose of the Website, individuals who wish to benefit from its services must hold the status of “Client”. The status of Client implies adherence to the Terms and Conditions of Sale, as well as the Legal Notice and Privacy Policy, in the version published at the time of accessing the Website. By placing an order, the Client accepts all these conditions of sale.

In any case, there are pages of the Website accessible to natural or legal persons who do not register or make a product purchase (hereinafter, “Users”). In this sense, Users who access these parts of the Website agree to be bound by the terms and conditions set forth in the Legal Notice, Privacy Policies, and Terms and Conditions of Sale, insofar as they may apply to them.

  2. DATA SECURITY.
    GRAPHENANO COMPOSITES, S.L. is committed to handling data confidentially, in accordance with our data protection policies. The services offered by GRAPHENANO COMPOSITES, S.L. on this site are contracted in a secure environment through the implementation of an SSL (Secure Sockets Layers) encryption system that ensures the protection of Internet communications with it. The Client/User can verify that they are in a secure operating environment by observing the closed padlock located at the bottom of their screen.

The User agrees to make lawful and appropriate use of this Website and the services provided by the company in accordance with this Legal Notice and to refrain from engaging in activities contrary to the law, morality, public order, and to make proper use of the present conditions. GRAPHENANO COMPOSITES, S.L. reserves the right to cancel any orders or deny access to the Website without prior notice and to take legal action as it deems appropriate in the event of any activity contrary to the law.

  1. CLIENTS.
    THE COMPANY wishes to inform its Clients and Users that it caters exclusively to professionals in the industrial sector, both in Spain and internationally.

  2. ERROR CORRECTION.
    You can correct errors related to the personal data provided during the purchasing process by contacting info@graphenano.com, and you may also exercise the right of rectification as stipulated in our Privacy Policy. If you detect an error in your order after completing the payment process, you must immediately contact our customer service at 965108102 or via email at info@graphenano.com to correct the error.

  3. PRODUCT DESCRIPTION AND AVAILABILITY.
    The information provided about each product, as well as photographs or videos relating to them, and the trade names, brands, or distinctive signs of any kind displayed on THE COMPANY’s website, are provided for guidance and may differ slightly from the actual product. All orders are subject to product availability. If there are supply difficulties or items are out of stock, we will contact the CLIENT to find a solution.

  4. PRICES.
    Prices on the website do NOT include VAT or shipping costs, which are calculated during the purchase process and, in any case, known to the customer before the order is finalised. Once the delivery address details are entered, and shipping options are selected, the system will display the total shipping costs. Prices may change at any time, but such changes will not affect orders for which we have already sent a Purchase Confirmation.

  5. PAYMENT METHODS.
    The payment methods are as follows:
    • Credit card
    You can pay by credit or debit card through our Virtual POS managed by CaixaBank and Redsys. We accept the following credit cards: Visa, Visa Electron, and MasterCard.
    If your credit card is rejected:

  • It may have expired. Check that the expiration date has not passed.
  • The card limit may have been reached. Consult with your bank to confirm the card has not exceeded its limit.
  • Some entered information may be incorrect. Check that you have filled in all required fields correctly.
    • American Express
    We accept payments with American Express. A surcharge of 3% of the total order amount, borne by the customer, will be included in the invoice for American Express payments.
  1. ORDER FORMALISATION.
    Once the order is formalised, i.e., with the acceptance of the Terms of Sale and the confirmation of the purchase process, THE COMPANY will always send an email to the CLIENT confirming the details of the purchase made. You can check the status of your order through the “Orders” tool, in the “My Account” section.

  2. ORDER CANCELLATION OR MODIFICATION.
    THE COMPANY will accept order cancellations and/or modifications when requested before the order is shipped. To make these changes, you must send an email to info@graphenano.com. However, the company does not guarantee that such changes can be made if the order is already in its final preparation phase, so it is advised to communicate these as soon as possible.

  3. DELIVERY TIME, PLACE, AND LOSSES.
    • Timeframe
    Unless product customisation or unforeseen circumstances occur, we will send the order related to each Shipping Confirmation within the following estimated timeframes:

  • Within 5 to 7 working days for domestic orders (across Spanish territory, including the Balearic Islands, Canary Islands, Ceuta, and Melilla).
  • Within 9 working days for orders in Europe.
  • Within a maximum of 30 days for the rest of the world.
    All timeframes are calculated from the date of the Order Confirmation.

• Delivery
Delivery will be made under Incoterm DAP conditions. THE COMPANY is not responsible for errors caused in delivery when the delivery address does not match reality or is omitted. THE COMPANY is not responsible for errors caused in delivery when the Client uses their transport company. THE COMPANY informs the Client that the same order may be divided into several deliveries. For security reasons, THE COMPANY will not send any orders to P.O. boxes or military bases, nor will it accept any order when it is impossible to identify the recipient and their address.

If, for any reason, we are unable to meet the delivery date, we will inform you of this and give you the option to proceed with the purchase by setting a new delivery date.

For the purposes of these Terms, “delivery” will be considered to have occurred when you or a third party indicated by you acquires physical possession of the products, which will be evidenced by signing for the receipt of the order at the agreed delivery address.

IMPOSSIBILITY OF DELIVERY
If we are unable to deliver your order, we will try to find a safe place to leave it. If we cannot find a safe place, your order will be returned to our warehouse. We will leave you a note explaining where your order is and how to arrange for it to be re-sent. If, after 15 days from the date your order is available for delivery, the order has not been delivered for reasons not attributable to us, we will consider the contract terminated. As a result of the termination of the contract, we will return the product price to you without undue delay, and in any case within 14 days from the date on which we consider the contract terminated.

Please note that transportation resulting from the termination may have additional costs, which we will be authorised to charge to you.

  1. RETURNS AND EXCHANGES.
    THE COMPANY does not consider the return of its products unless due to a fault with the products. If the return is attributable to THE COMPANY (the product is defective, not the one ordered, etc.), the return amount will be refunded, provided that the Client notifies THE COMPANY of their intention to return the purchased product(s) within a maximum of 30 working days from the delivery date, and provided all other conditions in this section are met.

After reviewing the return request, THE COMPANY will inform you of the shipping company to use. THE COMPANY accepts the exchange of products sold within a maximum of 30 working days from the delivery date. THE COMPANY will only accept exchanges that meet the following requirements:
• The product must be in the same condition in which it was delivered and must retain its original packaging and labelling, and must not have been tampered with.
• The products to be exchanged must have been stored under the storage conditions detailed on the product label and must not have been tampered with.
The return must be made using the same packaging in which it was received to protect the product.
• A copy of the delivery note must be included in the package, with the returned products and the reason for the return marked.
• The Product Return Request form, which will be sent to you once you have informed us of the need for an exchange, must be completed. This form must be accepted to process the return.

THE COMPANY establishes that the only procedure for return is that established by THE COMPANY. THE COMPANY will accept order cancellations and/or modifications when requested before the order is shipped. For this, you must send an email to info@graphenano.com. In no case may the Client return or exchange a product on their own without previously informing THE COMPANY.

• Customer Refunds
Only if the delivered product is defective or incorrect will the return of the products result in a refund, and THE COMPANY will refund the money, including the corresponding shipping costs to the Customer. THE COMPANY will process the refund order, preferably using the same method used for payment, within 5 days from the confirmation of the returned order’s arrival at the warehouse. The application of the refund to the Client’s account will depend on the issuing entity.

The contractual conditions specified in individual contracts will prevail over these more general conditions. In the event that one of these conditions is not covered in the individual contract, it will be understood that the contract is supplemented by these terms.

  1. WARRANTY.
    The products offered for sale function correctly and do not present defects or hidden issues that make them dangerous or unsuitable for use. THE COMPANY provides a warranty for its products only under the terms and for the periods established in its current warranty documents, unless otherwise required by law. Any other warranty is expressly excluded.

The warranty provided on the products and our responsibility concerning them will not include any damages resulting from improper or inadequate storage, transport, handling, or use of the products, including but not limited to damages resulting from not following the instructions for use, methods of use, and technical specifications.
